By accessing and using SavePoint Archives' services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Service Description and Availability

SavePoint Archives provides digital archival services, research access, and licensing for video game historical content. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

User Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

Acceptable Use Guidelines

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, overburden, or impair our servers or networks. Prohibited activities include but are not limited to unauthorized data scraping, reverse engineering, and distribution of malicious software.

Intellectual Property Rights

All content, features, and functionality of our services are owned by SavePoint Archives or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit permission.

Content Licensing and Usage Rights

Licensed content is provided for specific use cases as outlined in your subscription or licensing agreement. Commercial use requires appropriate licensing. Educational use is permitted under fair use guidelines with proper attribution.

Payment Terms and Billing

Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days' notice to existing subscribers.

Content Accuracy and Disclaimers

While we strive for accuracy in our historical content and metadata, we make no warranties about the completeness, reliability, or accuracy of information. Users should verify information independently for critical research purposes.

Limitation of Liability

SavePoint Archives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from your use of our services.

User-Generated Content Policy

By submitting content to our platform, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute such content in connection with our services. You retain ownership of your original content.

Dispute Resolution Procedures

Any disputes arising from these terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in New York, and the decision will be final and binding.

Account Termination Conditions

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will cease immediately.

Governing Law and Jurisdiction

These Terms shall be interpreted and governed by the laws of the State of New York, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the federal or state courts located in New York.

Modification of Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
